The short version: be at least 13, upload only photos you have the right to use, do not abuse the free tier or the AI, and know that subscriptions renew automatically until you cancel them in your device Settings. The full terms below are what legally applies.
These Terms of Use ("Terms") are a legal agreement between you and the developer of Nailed It ("Nailed It," "we," "us," or "our") governing your use of the Nailed It iOS application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.
These Terms are in addition to, and do not replace, Apple's standard End User License Agreement (the Apple Media Services Terms and Conditions), which also applies to your use of the App as a "Licensed Application."
The App is rated 12+ on the App Store because it allows user-generated and user-uploaded photo content with a moderation layer. You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement and consent of a parent or legal guardian.
Nailed It does not require you to create an account, sign in, or provide a username or password. There is no user database. All designs, edit history, favorites, and photos you use in the App are stored locally on your device, as described in our Privacy Policy. Because there is no account, there is nothing to delete on our end beyond what already happens automatically when you delete the App or its data from your device.
The App allows you to upload or capture photos, including photos of your hand and nails, inspiration photos, outfit photos, and images imported from other apps (such as Pinterest, Instagram, or Safari) via the share sheet ("Your Content"). You retain all rights to Your Content. By using the App, you grant us the limited right to transmit Your Content to our AI processing partner solely for the purpose of generating your requested nail design or try-on image, as described in our Privacy Policy. We do not claim ownership of Your Content, and we do not store Your Content on any server beyond the momentary processing required to generate your result.
You represent that you own or have the necessary rights to any photo you upload, and that uploading it does not infringe any third party's rights (including copyright) or violate any law.
You agree not to use the App to upload, generate, or attempt to generate content that:
Every photo you upload, whether a hand photo, an inspiration image, or an imported image, is screened by an automated safety check before processing. We may decline to generate a result, and may suspend a device's access to the App, if we reasonably believe these Terms have been violated.
Designs and try-on images produced by the App are generated using artificial intelligence and are provided for inspiration and visualization purposes only. AI-generated results are not guaranteed to be achievable by any nail technician or salon, may not perfectly reflect real-world materials, lighting, or hand anatomy, and may occasionally contain visual artifacts or inaccuracies. You are solely responsible for evaluating the suitability of any design before acting on it (for example, before requesting it at a salon).
Nailed It offers auto-renewing subscription plans (weekly, monthly, and annual), each billed at the price and interval shown in the App and on the App Store at the time of purchase. Where offered, a free trial (currently 3 days) precedes the first billing cycle. Specifically:
The App offers one-time, non-renewing consumable purchases ("top-up packs") that add extra design generations to your balance, on top of your monthly subscription allowance. Top-up packs are single-use digital items: once purchased, the credits are added to your balance and the purchase cannot be refunded except as required by Apple's App Store refund policies or applicable law. Extra credits from top-up packs do not expire.
New installations of the App receive a limited number of complimentary design generations and try-ons before a subscription is required. This allowance is tracked per device (not per Apple ID or account) to give every user a fair first experience of the App, and is separate from Apple's own free-trial eligibility tracking for subscriptions. Attempting to circumvent this limit (for example, by repeatedly deleting and reinstalling the App to obtain additional free credits) is a violation of these Terms.
The App, including its design, code, trademarks, and the "Nailed It" name and logo, is owned by us and protected by intellectual property laws. Except for Your Content, nothing in these Terms grants you any right to use our trademarks, logos, or branding.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED RESULTS WILL MEET YOUR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if you violate these Terms. Since the App does not use accounts, termination on our end is limited to device-level enforcement (for example, blocking further free-tier abuse from a given device).
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where required, by an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence provide otherwise.
